These terms and conditions outline the rules and regulations for the use of Medicai’s Website, located at https://www.medicai.io.
By accessing this website we assume you accept these terms and conditions. Do not continue to use medicai.io if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Unless otherwise stated, Medicai and/or its licensors own the intellectual property rights for all material on medicai.io. All intellectual property rights are reserved. You may access this from medicai.io for your own personal use subjected to restrictions set in these terms and conditions.
You must not:

- Sell, rent or sub-license material from medicai.io
- Reproduce, duplicate or copy material from medicai.io
- Redistribute content from medicai.io
This Agreement shall begin on the date hereof.
Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. Medicai does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of Medicai,its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, Medicai shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
Medicai reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.
You warrant and represent that:

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to Medicai. Wait 2-3 weeks for a response.
Approved organizations may hyperlink to our Website as follows:
- By use of our corporate name; or

No use of Medicai’s logo or other artwork will be allowed for linking absent a trademark license agreement.

We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. Reservation of Rights
We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and it’s linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.
Removal of links from our website
If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly.
We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.
Subscriptions for Doctors
Starting with June 1, 2021, all new users benefit from the Starter subscription which includes 2 GB of free storage. Thus, starting with this date, the pricing plan that includes 20 GB of free storage will no longer apply.
As of July 1, 2021, our pricing plans are those detailed below, both for existing users as of July 1, 2021, and for all new users who create an account as of July 1, 2021 (inclusive). The pricing
- Starter subscription: includes 25 GB free storage (~50-100 patients*)
If you need more storage space, you can contact us and we will do our best to help you.
*Storage is based on the size of all imaging investigations and documents stored in the account. The actual number of patients may and will differ. This is only an approximate estimate of the number of patient investigations that can be included in the storage size.
What will doctors' subscriptions include?
All subscriptions mentioned above will include the following features:
- viewing DICOM files online
- viewing medical documents
- unlimited collaborators in cases of patients
- investigations received from patients directly in the doctor's account, directly through the public page
- real-time chat with other doctors on cases
- request payments from patients (requires validation)
- a single account - multiple workspaces
- data security
- public community of physicians and clinics in Medicai
- public profiles of physician and clinic (future)
- communication with the patient directly in Medicai (future)
- easier distribution of cases and public cases (future)
- section notes, signing documents (future)
From the launch date, all users who have a paid subscription (Professional Subscription or Premium Subscription), as well as those existing before July 1, 2021, will be able to use the video call function for up to 4 participants simultaneously.
We also offer annual subscriptions for each of the pricing plans mentioned above, for which we grant a 10% discount on the full payment of the subscription for one year.
To avoid any doubt, we mention that all the information in this section is intended for doctors' accounts, patient accounts are free.
We have also implemented personalized subscriptions and online payments for our enterprise clients (clinics, hospitals, or institutes), but they are managed on a case-by-case basis and the subscriptions mentioned above in this section do not apply to them.
How do I subscribe?
To choose a subscription, a user will need to navigate to the subscription settings section of their account.
Once the "Subscription settings" section is selected, the user can choose to change the existing subscription by clicking on the "Change subscription" button.
In the following steps, the user will be able to choose one of the existing subscriptions in the Medicai platform and will be able to add the billing details, both for individuals and for legal entities.
After confirming or completing the billing data, the user will be able to enter the card data to make the payment. The last step is to make the payment, after pressing the "Confirm payment" button.
Users will be able to activate recurring payments by checking the "Enable recurring payments" box.
By completing the procedure for purchasing a subscription, the user agrees that all data provided by him, necessary for the purchase process, are correct, complete, and true at the time of purchase.
Medicai reserves the right not to honor any order regarding subscriptions and to cancel the order placed by the user, following prior notification to the user, without any subsequent obligation of any party to the other or without any party being able to claim the other damages in the following cases:
(i) non-acceptance by the issuing bank of the user card or of the transaction;
(ii) invalidation of the transaction by the card processor approved by Medicai;
(iii) the data provided by the user, on the site (medicai.io), for the creation of the account/subscription are incomplete and/or incorrect;
(iv) the user's activity on the site (medicai.io) may and/or cause damages of any kind to Medicai and/or its partners;
(v) for other objective reasons.
What will happen to the existing doctor's accounts on July 1, 2021?
Because we want to thank our users, who created their account before July 1, 2021, because they helped us grow, all their doctor accounts still benefit from 20 GB of storage space, and the call function video for up to 4 participants simultaneously is provided free of charge.
What happens after I exceed the subscription storage space?
Exceeding the storage space of the subscription will have a minimal impact on your activity (applied to doctor's accounts). You will still be able to access all cases, communication, video calling function (if you have an old paid plan or a free plan), request payments, collaborate with unlimited doctors, create new cases, upload new documents and investigations, and more.
Account limitations apply only to imaging investigations and older uploaded documents (starting with the first-ever uploaded in Medicai) that exceed the subscription limit. So, for example, if I have reached 20 GB of investigations in my account and upload another investigation, only older investigations that cannot be included in the subscription limit will not be accessible - lack of access means you will not be able to open them with the DICOM viewer. Investigations that exceed the subscription storage limit will not be deleted, they still belong to you and you will be able to access them once you update your storage space.
Thus, we allow doctors to work uninterruptedly even when the storage limit is exceeded.
Can I change my subscription?
Yes. To change your subscription, you can access your account settings and choose the “Subscriptions" tab. Here you will be able to view your existing subscription and you will be able to choose to modify it.
If you want a personalized subscription, with a personalized storage plan, contact us and we will do our best to help you.
What are the payment options?
You can pay a direct subscription to Medicai with a credit or debit card. You can also set up recurring payments and thus forget about manual monthly payments. All online payments are secure and we do not store sensitive Medicai information. Everything is managed by our payment provider, Stripe Technology Company Limited. You can find more details about Stripe on their website: stripe.com.
The user's payment card data will not be accessible to Medicai and will not be stored by Medicai, but only by Stripe Technology Company Limited, a company incorporated and operating under the laws of Ireland, headquartered in 25/28 North Wall Quay. , Dublin, tax code IE564555, which ensures, through its payment processing service, the online payment with the bank card.
For reasons of transaction security, the user is advised not to remain logged on to the site (medicai.io) and not to set the option of automatic login on mobile devices. Disclosure of the access password to the user account is not permitted and it is recommended to use a strong security password (eg to contain at least eight characters, including uppercase, lowercase, numbers, and special characters).
What currencies are accepted?
Although all subscriptions are displayed in EURO, you can pay in almost any other currency. Our system will convert the subscription price into the local currency (card). Also, all prices include VAT.
Will I receive an invoice for my payment?
Yes. All invoices will be generated by Stripe and you will be able to download them from your account. You can also add company details on the invoice if you wish. The user is obliged to provide all the information necessary to issue the invoice according to the legislation in force.
Can I cancel/terminate my subscription?
Yes, you can cancel/terminate your purchased subscription at any time, in which case you have two options: either keep the canceled/terminated subscription until the end of the current period (the period for which you paid the canceled/terminated subscription) or change your subscription canceled/terminated with another subscription, in which case you will also benefit from the credit remaining from the remaining active period (eg: if you still have 5 days from the canceled/terminated subscription and you want to buy another subscription, we will take into account the 5 days remaining from the canceled/terminated subscription and we will deduct the credit related to the 5 days, already paid by you, from the total price of the new subscription).
If you have configured the recurring payment for the monthly subscription you want to cancel/stop, please cancel it from your account on the site (medicai.io). However, if you forgot, and the automatic payment was made after the cancellation/termination of the subscription, we will be able to refund your money in the refund conditions below.
How do you manage refunds?
If you want to make a refund request, as a result of canceling/terminating a subscription, you will need to contact our support team and we will try to help you. The terms and conditions of this document apply to all refunds.
- For monthly subscriptions: the refund is made if you make a request to cancel/terminate the subscription within 5 days from the initial purchase of the subscription
- For annual subscriptions: the refund is made if you make a request to cancel/terminate the subscription in at most 14 days from its initial acquisition
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:
- limit or exclude our or your liability for death or personal injury;
- limit or exclude our or your liability for fraud or fraudulent misrepresentation;
- limit any of our or your liabilities in any way that is not permitted under applicable law; or
- exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.
As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.
